WAIVER AND RELEASE OF LIABILITY AGREEMENT *

I hereby acknowledge that I have voluntarily enrolled my child (listed above) in the Strokes for Little Folks class offered by Melissa Kady of Melissa Kady Art LLC (hereinafter “MKA”). I understand that this class involves the use of art-related materials and I agree to WAIVE, RELEASE and DISCHARGE MKA, including its directors, officers, employees, volunteers, representatives, and agents from any claims of damage against person or property, whether foreseeable or unforeseeable, that may occur while my child is participating in the Strokes for Little Folks art program, whether such damage is directly or indirectly related to said art lesson. I certify that I am of sound mind and abilities, and that I fully comprehend the contents and effect of this release. I further certify that at the time of signing this release I am not under the influence of any substances that impede my decision- making ability, and that I am not experiencing any health-related reasons or problems which preclude my ability to understand and comprehend the contents of this form. I certify I am signing this release freely and voluntarily and not under any duress. I AGREE THAT ANY LEGAL ACTIONS involving this WAIVER AND RELEASE OF LIABILITY AGREEMENT shall be brought in Broward County, Florida. MKA is entitled to reimbursement of any and all attorney fees and costs incurred in any type of litigation or legal dispute involving the enforcement of this WAIVER AND RELEASE OF LIABILITY AGREEMENT. I CERTIFY THAT I AM THE PARENT AND/OR LEGAL GUARDIAN OF THE CHILD NAMED ABOVE. I FURTHER CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT.

APPEARANCE RELEASE *

I understand that Melissa Kady at times will produce promotional material relating to their classes or events held there. I understand that as a participant the minor may be photographed or videotaped during their class or other event. I hereby grant Melissa Kady, the exclusive right to photograph or videotape the minor and to utilize the minor’s name, face, likeness, voice and appearance in advertising and promotional material without reservation or limitation. I understand that in granting these rights that Melissa Kady is under no obligation to exercise any of these forgoing rights, licenses and privileges herein granted.
